The Senate met at 11 a.m.
(Senator Tomblin, Mr. President, in the Chair.)

Prayer was offered by the Honorable Walt Helmick, a senator from the fifteenth district.
Pending the reading of the Journal of Wednesday, March 14, 2007,
On motion of Senator Edgell, the Journal was approved and the further reading thereof dispensed with.
The Senate proceeded to the fourth order of business.
Senator Love, from the Committee on Confirmations, submitted the following report, which was received:
Your Committee on Confirmations has had under consideration
Senate Executive Message No. 6, dated March 13, 2007, requesting confirmation by the Senate of the nomination named therein. The following name from Executive Message No. 6 is submitted:
1.For Member, State Board of Education, Gayle Conelly Manchin, Charleston, Kanawha County, for the term ending November 4, 2015.
And reports the same back with the recommendation that the Senate do advise and consent to the nomination listed above.

The time having arrived for the special order of business to consider the nominee for public office submitted by His Excellency, the Governor, the special order thereon was called by the President.
Thereupon, Senator Tomblin (Mr. President) laid before the Senate the following executive message:
Senate Executive Message No. 6, dated March 13, 2007 (shown in the Senate Journal of Wednesday, March 14, 2007, page 2).
Senator Love then moved that the Senate advise and consent to the executive nomination referred to in the foregoing report from the Committee on Confirmations.
The question being on the adoption of Senator Love's aforestated motion,
The roll was then taken; and
On this question,
the yeas were: Bailey, Barnes, Boley, Bowman, Caruth, Chafin, Deem, Edgell, Facemyer, Fanning, Foster, Green, Guills, Hall, Helmick, Hunter, Jenkins, Kessler, Love, McCabe, McKenzie, Minard, Oliverio, Plymale, Prezioso, Sprouse, Stollings, Sypolt, Unger, Wells, White, Yoder and Tomblin (Mr. President)--33.
The nays were: None.
Absent: Sharpe--1.
So, a majority of all the members elected to the Senate having voted in the affirmative, the President declared Senator Love's aforestated motion had prevailed.

Consideration of the executive nomination having been concluded,
Without objection, the Senate returned to the third order of business.
Executive Communications

The Clerk then presented a communication from His Excellency, the Governor, advising that on March 14, 2007, he had approved Enr. Senate Bill No. 594.
The Senate proceeded to the thirteenth order of business.
Senator Kessler called attention to today being the birthday of the senator from Logan and on behalf of the Senate extended felicitations and good wishes to Senator Tomblin (Mr. President), with Senator Love leading the members in singing "Happy Birthday".
On motion of Senator Chafin, the Senate adjourned until tomorrow, Friday, March 16, 2007, at 6 p.m.
